BLANCO ABOGADOS
An international estate cannot be managed as a collection of isolated formalities. Before assets are accepted, transferred or divided, it is necessary to determine which law governs the succession, which authorities have jurisdiction, what forms part of the estate and which obligations arise in each country.
Blanco Abogados directs estates involving deceased persons, heirs, wills or assets connected with the Dominican Republic, Spain or other jurisdictions. We coordinate the legal, notarial, registry and tax steps so that the succession is treated as a single matter.
We handle the principal stages of estate administration: obtaining the necessary certificates, examining wills, identifying heirs and assets, preparing declarations of heirs where required, accepting or renouncing the inheritance and completing the partition and transfer of the estate.
Where the succession has effects in the Dominican Republic, we also coordinate the documentation and filings required before the Directorate General of Internal Revenue and the settlement of inheritance tax when applicable.
The first legal question is often not how the estate should be divided, but which law governs it. The answer may depend on the deceased's habitual residence, domicile, nationality, the terms of the will, any valid choice of law and the countries in which the assets are situated.
We analyse these connections before taking substantive steps and determine which courts, notaries or authorities may intervene. This avoids contradictory proceedings and decisions based on a law that is not applicable to the succession as a whole.
An estate may include property, company shares, bank accounts, investments, debts and other assets situated in different countries. Each category requires its own documentation and formalities, but all must be incorporated into a common legal and financial assessment.
We coordinate valuations, registry information, corporate documents and banking requirements, and organise the transfer or sale of assets in accordance with the agreed partition and the rules applicable in each jurisdiction.
Disagreements may arise over the validity or interpretation of a will, the identification and valuation of assets, lifetime gifts, the management of the estate or the shares corresponding to each heir.
We define the legal position of each party, preserve the necessary evidence and seek a negotiated partition where it adequately protects the client's interests. Where agreement is not possible, we conduct the corresponding court proceedings and coordinate their effects in the other jurisdictions involved.
Advance planning is particularly important where a person owns assets, companies or investments in more than one country. A will or corporate arrangement prepared without considering all relevant jurisdictions may create avoidable conflicts, delays or tax consequences.
We review the personal, family and financial circumstances of the client and coordinate wills, ownership structures and succession arrangements so that the transfer of wealth is legally coherent and capable of being implemented.
Each estate must be approached as a whole: family, assets, applicable law and jurisdictions form part of the same legal strategy.
